DMCA POLICY 

This Digital Millennium Copyright Act (“DMCA”) Policy applies to the website jewishintampabay.com (the “Website”), owned and operated by Project M Ventures LLC (“Company”, “we”, “us”, or “our”).

    • You are authorized to act on behalf of the copyright owner

Incomplete or invalid notices may not be processed.

2. How to Submit a DMCA Notice

Submitting your notice by email is generally the fastest method.

3. What Happens After a Valid Notice Is Received

When we receive a valid and complete DMCA notice:

  1. We will review the claim.

  2. The allegedly infringing material may be removed or disabled.

  3. We may notify the user who posted or controls the material.

  4. That user will have the option to submit a counter-notification (see below).

We act in good faith to comply with the DMCA but reserve the right to investigate and verify claims before taking action where appropriate.

4. Counter-Notification (Restoration Requests)

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification.

Your counter-notification must include:

  1. Your physical or electronic signature

  2. Identification of the material that was removed or disabled and the location where it appeared before removal

  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification

  4. Your full contact information:

    • Name

    • Address

    • Telephone number

    • Email address

  5. A statement that you consent to the jurisdiction of:

    • The U.S. Federal District Court for your judicial district, or

    • If you are outside the United States, the courts located in California, USA

  6. A statement that you will accept service of process from the person who submitted the original DMCA notice (or their agent)

5. Restoration of Removed Content

After we receive a valid counter-notification:

  • We may provide a copy of it to the original complainant.

  • If the complainant does not file a court action seeking to restrain the alleged infringement within the time required by law (typically 10–14 business days), we may restore the removed material.

We are not obligated to restore content and may decide not to do so if there are other legal or policy concerns.

6. Repeat Infringer Policy

In appropriate circumstances, we may suspend or permanently terminate access for users who are determined to be repeat copyright infringers.

We reserve the right to remove content and/or disable user accounts even upon a single substantiated infringement claim.

7. Misrepresentation and False Claims

Under the DMCA, any person who knowingly makes a false or misleading claim of infringement or counter-claim may be liable for damages, including legal fees.

By submitting a DMCA notice or counter-notification, you acknowledge and accept this responsibility.

8. Good Faith and Fair Use

Not all uses of copyrighted material are infringing. Certain uses may be permitted under the doctrine of “fair use” or other legal exceptions.

Before submitting a DMCA notice, you should carefully consider whether the use you are reporting may be legally permitted.

We may, at our discretion, decline to act on notices that appear to target lawful or fair use.

9. Third-Party Content

Some content on the Website may be provided or hosted by third parties.

While we will respond to valid DMCA notices, we are not automatically responsible for content posted by third parties. Our role is limited to acting as a service provider under applicable law.

10. Policy Updates

We reserve the right to modify or update this DMCA Policy at any time.

Any changes will be effective immediately upon posting the revised policy on the Website. Continued use of the Website after changes are posted constitutes acceptance of the updated policy.
